Terms of Service

 

Effective date: April 29, 2026.

 

These Terms of Service (the "Terms") are a legally binding agreement between you and DivideNPac LLC, doing business as by Myriad LLC ("DivideNPac," "we," "us," or "our"). They govern your use of dividenpac.com (the "Service") and your purchase of our products.

By accessing the Service or placing an order, you agree to these Terms. If you don't agree, please don't use the Service or place an order.

Please read Sections 14 and 15 carefully. Section 14 (Governing Law) and Section 15 (Dispute Resolution) require most disputes between you and DivideNPac to be resolved through binding individual arbitration rather than court, and waive your right to participate in class actions. Section 15 also gives you 30 days after these Terms first become binding on you to opt out of arbitration by emailing legal@dividenpac.com.

1. Who we are

DivideNPac LLC dba by Myriad LLC is a California limited liability company. Our mailing address is 1014 S. Westlake Blvd, #14-242, Westlake Village, CA 91361. You can reach us at info@dividenpac.com or 310-999-4554.

2. Definitions

  • "Service" means the DivideNPac website at dividenpac.com and any related services we provide.
  • "Products" means the organizers, bags, accessories, and other goods we offer for sale.
  • "You" means the individual or entity accessing the Service or purchasing Products.
  • "Content" means text, images, video, graphics, reviews, and other materials on the Service.
  • "User Content" means Content you submit to us — reviews, photos, testimonials, messages.

3. Eligibility and accounts

Age

  • You must be at least 18 years old to place an order or create an account without a parent or legal guardian's involvement.
  • Minors aged 13–17 may use the Service and place orders only with a parent or legal guardian's consent and supervision, and the parent or guardian is responsible for the order.
  • The Service is not intended for children under 13. We do not knowingly collect personal information from children under 13 (see our Privacy Policy).

Accounts

  • You're responsible for keeping your account credentials confidential.
  • You're responsible for all activity under your account.
  • Notify us at info@dividenpac.com if you believe your account has been accessed without your permission.
  • We may suspend or terminate accounts at our discretion, particularly for violations of these Terms.

4. Prohibited uses

You agree not to:

  • Violate any applicable law or regulation
  • Infringe intellectual property, privacy, or other rights of DivideNPac or anyone else
  • Transmit viruses, malware, or malicious code
  • Harass, abuse, threaten, or harm others through the Service
  • Attempt unauthorized access to our systems, accounts, or data
  • Scrape, crawl, or copy Content without written permission, except as permitted by robots.txt for standard search indexing
  • Use the Service in any manner that could disable, overburden, damage, or impair it
  • Interfere with any other user's use of the Service

5. Products, pricing, and orders

Product information

We do our best to describe and photograph Products accurately. Colors on your screen may vary from actual product colors due to monitor calibration and lighting. Dimensions, weights, and materials listed are approximate.

Pricing

  • All prices are in U.S. dollars unless stated otherwise.
  • Prices can change without notice.
  • Prices don't include applicable taxes or shipping (unless shipping is noted as free for the relevant region).
  • We may limit order quantities at our discretion.

Order acceptance and cancellation

  • Your order is an offer to purchase. The order is accepted only when we ship the order, not when you receive the order confirmation email.
  • We may decline or cancel any order at our discretion, including for reasons of stock availability, pricing errors, suspected fraud, shipping restrictions, or violation of these Terms.
  • If we cancel an order that has already been paid for, we'll refund the full amount paid, typically within 5–7 business days. We're not otherwise liable for order cancellations.
  • Pricing errors: if a Product is listed at an obviously incorrect price (significantly below our cost or the product's reasonable retail value), we reserve the right to cancel those orders and refund you in full, even after order confirmation.

6. Payment

Payment methods

We accept major credit cards, debit cards, PayPal, and Shop Pay, as displayed at checkout. By submitting payment information, you represent that you're authorized to use the payment method and authorize us to charge it for the total amount of your order, including taxes and any applicable shipping.

Payment processing

Payment processing is handled by third-party processors (Shopify Payments, PayPal, Shop Pay) that adhere to PCI-DSS standards. We don't store your full credit card number on our servers. See our Privacy Policy for more on payment data.

7. Shipping, delivery, and risk of loss

Shipping terms, times, and costs are detailed in our Shipping Policy, which is incorporated into these Terms by reference.

Title and risk of loss pass to you when the carrier accepts the package for shipment. If the package is lost or damaged in transit, follow the process in our Shipping Policy — we'll work with the carrier to file claims and will replace or refund at our discretion.

International orders: you're responsible for all customs duties, taxes, and import fees charged by the destination country.

8. Returns and refunds

Returns, exchanges, and refunds are governed by our Returns & Cancellations Policy, which is incorporated into these Terms by reference.

Key points: non-food items may be returned within 15 days of delivery (30 days total to ship back) if unused and in original packaging. Food-grade items are non-returnable for health and safety reasons, except for defects. Sale items and items purchased with sale-specific discount codes are non-returnable. 9. Limited product warranty

What's covered

We warrant that non-food DivideNPac Products are free from manufacturing defects in materials and workmanship for 90 days from the date of delivery, when used as intended.

Food-grade Products: defective or damaged food-grade items are replaced free under the Returns & Cancellations Policy, regardless of the 90-day warranty period.

What's not covered

  • Normal wear and tear
  • Damage from misuse, neglect, or use inconsistent with product instructions (including dishwasher use — our Products are hand wash only)
  • Cosmetic issues that don't affect function
  • Loss, theft, or damage during shipping after delivery
  • Accidental damage, including damage from drops, punctures, or exposure to heat
  • Products modified, altered, or repaired by anyone other than DivideNPac

How to make a warranty claim

Email returns@dividenpac.com within the 90-day warranty period with:

  • Your order number
  • Photos of the defect and the overall Product
  • A brief description of the issue and how it occurred

We'll review and, at our discretion, repair, replace, or refund the Product. Our liability under this warranty is limited to the remedies described here. This warranty is not transferable and applies only to the original purchaser.

This warranty gives you specific legal rights. You may have other rights that vary by state. To the extent any implied warranties cannot be disclaimed under applicable law, those warranties are limited in duration to the 90-day warranty period described here, where permitted by state law.

10. Intellectual property

Our content

The Service and all of its Content — including text, graphics, logos, icons, images, photographs, software, and the DivideNPac name and design marks — are owned by DivideNPac or our licensors and are protected by copyright, trademark, patent, and other intellectual property laws. DivideNPac's patented organizer designs are covered by more than 15 US patents.

Limited license to you

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license doesn't include the right to:

  • Resell or commercially exploit the Service itself or its Content (this applies to the website and materials, not to Products you've legally purchased)
  • Use data mining, scraping, or automated tools on the Service
  • Download or copy account information for the benefit of another party
  • Reverse engineer, decompile, or disassemble any portion of the Service

Your content

When you submit User Content (reviews, photos, testimonials, messages), you keep ownership of it. You grant us a worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and display that User Content in connection with operating and promoting DivideNPac, across any media now known or later developed.

You can revoke this license for any specific piece of User Content by emailing legal@dividenpac.com with a reasonably specific identification of the content. We'll remove it from our controlled channels within a reasonable time, though we can't remove it from third-party platforms where it's been publicly shared or from archives maintained by third parties.

You represent and warrant that: (a) you own the User Content or have the right to grant this license; (b) your User Content doesn't violate any law or third-party right; and (c) any depicted individuals have consented to being shown.

Feedback

If you send us feedback, ideas, or suggestions, we can use them freely without any obligation to you.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share your personal information. The Privacy Policy is incorporated into these Terms by reference.

12. Disclaimers

The Service and Products are provided on an "AS IS" and "AS AVAILABLE" basis.

Except for the limited product warranty in Section 9, and to the fullest extent permitted by applicable law, DivideNPac disclaims all warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We don't warrant that the Service will be uninterrupted, secure, or error-free; that defects will be corrected; or that the Service or the servers that make it available are free of viruses or other harmful components.

Some jurisdictions don't allow the exclusion of implied warranties. In those jurisdictions, the exclusions above apply to the fullest extent permitted by applicable law, and the limited product warranty in Section 9 gives you specific legal rights that vary by state.

13. Limitation of liability

To the maximum extent permitted by applicable law:

  • DivideNPac will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenues, data, use, or goodwill, arising out of or related to your use of the Service or Products, even if we have been advised of the possibility of such damages.
  • Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service, whether in contract, tort (including negligence), strict liability, or otherwise, will not exceed the greater of (a) the amount you paid for the specific Product that is the subject of the claim, or (b) one hundred US dollars ($100).

Some jurisdictions don't allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the fullest extent permitted by applicable law.

The limitations in this Section reflect a reasonable allocation of risk between you and DivideNPac and are a basic part of the bargain between us.

14. Governing law and jurisdiction

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of California, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods doesn't apply.

Subject to the arbitration provisions in Section 15, any legal action not subject to arbitration must be filed in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

15. Dispute resolution — please read carefully

Binding arbitration and class action waiver. Section 15 requires most disputes between you and DivideNPac to be resolved through binding individual arbitration instead of in court, and you waive your right to participate in a class action. You have 30 days after these Terms first become binding on you to opt out of this section by following the procedure in Section 15.5.

15.1 Informal resolution

Before filing a formal dispute, please contact us at legal@dividenpac.com with a written description of your claim, the amount or relief you're seeking, and your contact information. We'll try in good faith to resolve the matter within 60 days. Many disputes can be resolved informally, and we'd rather solve the problem than litigate it.

15.2 Arbitration agreement

If we can't resolve the dispute informally within 60 days, you and DivideNPac agree that any dispute arising out of or relating to these Terms, the Service, or the Products — other than the exceptions in Section 15.4 — will be resolved through binding individual arbitration.

The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The AAA rules are available at adr.org. The arbitration will be conducted by a single arbitrator and will take place in Los Angeles County, California, or through videoconference if you prefer. The arbitrator's decision is final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

15.3 Class action and jury trial waiver

You and DivideNPac each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both parties waive the right to a jury trial.

15.4 Exceptions to arbitration

The following claims are not subject to arbitration:

  • Claims in small-claims court, as long as they remain in that court and aren't transferred or appealed to another court
  • Claims for injunctive or equitable relief to prevent actual or threatened infringement of intellectual property rights
  • Claims that cannot be arbitrated under applicable law

15.5 Opt-out right

You can opt out of the arbitration requirement in Section 15.2 and the class action waiver in Section 15.3 by emailing legal@dividenpac.com within 30 days after these Terms first become binding on you (for new customers, this is the date of your first order; for existing customers, this is the effective date of these Terms). Your opt-out email must include your full name, the email address and mailing address associated with your account, and a clear statement that you want to opt out of arbitration. Opting out doesn't affect any other provision of these Terms.

15.6 Costs of arbitration

Arbitration fees will be governed by the AAA's Consumer Arbitration Rules. If you can't afford the arbitration filing fee and the amount in dispute is $1,000 or less, we'll pay the filing fee on your behalf if you request it at the time of filing.

16. Indemnification

You agree to defend, indemnify, and hold harmless DivideNPac, its affiliates, and its officers, directors, employees, contractors, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right.

17. Force majeure

DivideNPac isn't liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, fires, floods, pandemics, epidemics, governmental actions, labor shortages, supplier failures, shipping carrier disruptions, internet or utility outages, cyberattacks, or war. We'll take reasonable steps to resume performance as soon as the event ends.

18. Electronic communications and E-SIGN

By using the Service or providing us with your email address or phone number, you consent to receive communications from us electronically — including order confirmations, shipping notifications, service announcements, and other communications related to your account or orders. You agree that all notices, agreements, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

This consent is your agreement under the Federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act). You can withdraw this consent for marketing communications at any time by unsubscribing (links are in every marketing email), but withdrawing consent for transactional or legal communications would make it impossible for us to fulfill your order, so you may need to close your account instead.

19. Changes to these Terms

We may update these Terms from time to time. When we make material changes:

  • We'll post the updated Terms on this page and update the "Effective date" and "Last updated" dates
  • For changes that significantly affect your rights, we'll notify you by email (if you have an account) at least 30 days before the changes take effect
  • Your continued use of the Service after the effective date of updated Terms means you accept the changes
  • If you don't agree to the updated Terms, your only recourse is to stop using the Service and, if applicable, close your account

20. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, for any violation of these Terms or for any other reason we consider appropriate in our sole judgment.

You may stop using the Service at any time. Terminating your account doesn't relieve you of any obligations for orders placed before termination. Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution — will survive.

21. Severability

If any provision of these Terms is held unenforceable, the remaining provisions stay in full force. The unenforceable provision will be replaced by an enforceable provision that most closely matches the intent of the original.

22. Waiver

If we don't enforce a right or provision in these Terms, that's not a waiver of our right to do so later.

23. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction, for example in connection with a merger, acquisition, or sale of assets. Any attempted assignment in violation of this Section is void.

24. Entire agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Returns & Cancellations Policy, are the entire agreement between you and DivideNPac regarding the Service and Products, and they supersede any prior agreements or communications on the same subject.
